DUI Breathalyzer Test: Basics of Testing & Toxicology
The introduction to Breath Testing Course will present Defense Attorneys the opportunity to learn about the basics of Breath Testing including the theories and science upon which Breath Testing is based. The Origins of Breath Testing as well as breath testing today and in the future will be explored. Attorneys will learn about the Breath test procedure, including possible errors that can occur at each step in the Breath Testing Process. Further, issues with the breath test machines will be explored. Strategies for keeping Breath Test results from being admitted as evidence at trial will be presented. Finally a comprehensive review and strategies for dealing with bad breath test results at trial will complete the program.

Attorney David Katz

A founding partner of Katz & Phillips, P.A., David Katz is a former Assistant State Attorney and DUI / Intoxilyzer Specialist with the Seminole County State Attorney's Office and has prosecuted cases in both Orange and Seminole Counties.

Chosen by the Florida Prosecuting Attorney's Association, David taught DUI trial skills to new prosecutors statewide. As the Seminole County Intoxilyzer Specialist, he received unique training and experience with the Intoxilyzer 8000, including access to the manufacturer of the device, which he now uses to aid in the defense of DUI cases.

David has been the featured Speaker at Continuing Legal Education Seminars focused on DUI Defense, lecturing to Attorneys practicing DUI Defense throughout the State. David is also a co-Author of the Inside the Minds Series book focusing on DUI cases.

As a defense Attorney David has focused his practice on DUI defense and has played a key role in the suppression of hundreds of Breath Test results in Central Florida and surrounding areas, acting as the Lead Attorney in Suppression hearings focusing on Source code and machine malfunction issues.

James D. Phillips is a former prosecutor from Escambia and Seminole County. As a former Assistant State Attorney, Mr. Phillips prosecuted thousands of cases with a primary focus on DUI. Mr. Phillips is an aggressive trial attorney, who uses his knowledge and experience as a prosecutor to zealously advocate for his clients. Although the vast majority of his practice is strictly dedicated to DUI defense, Mr. Phillips has represented individuals charged with misdemeanors, felonies, sex crimes, violent crimes, internet crimes, felonies punishable by life and murder. Mr. Phillips also handles criminal cases at the Federal level. Mr. Phillips has been the key speaker at various DUI seminars in which he has lectured and instructed other attorneys. Mr. Phillips has co-authored a book on DUI Defense and authored training manuals on DUI Defense used by other attorneys.
